2. Information We Collect

We collect several types of information from and about users of our Platform and Website, including:

Personal Information

"Personal Information" (or "personal data") means information about an identified or reasonably identifiable individual. The types of Personal Information we may collect include:

  • Identity and contact data: Name, email address, and account credentials
  • Payment information: Billing details and payment method information (processed by our payment provider; we do not store full card numbers)
  • Network and device data: IP address, browser type, operating system, device identifiers, and language preferences. IP addresses are personal data because they can be used to identify you, either alone or in combination with other information.
  • Usage data: Pages visited, features used, clickstream data, session duration, and interaction with our Platform
  • Content data: Videos, audio files, images, transcripts, subtitles, thumbnails, and other media you upload or generate through the Platform
  • Voice clone data: Voice samples and synthesized voice outputs created through our AI dubbing features
  • Session recordings: Screen recordings and interaction replays captured when you use our Platform (only with your consent)
  • API usage data: Requests made through our APIs, including authentication tokens and usage metrics
  • Communications: Messages you send to our support team and feedback you provide

3. How We Collect Information

We collect information in the following ways:

  • Directly from you: When you create an account, upload content, make a payment, configure your settings, contact support, or otherwise interact with our Platform and Website.
  • Automatically: Through cookies, pixels, web beacons, analytics tools, session recording technologies, server logs, and similar technologies when you visit our Website or use our Platform. See our Cookie Policy for details.
  • From third parties: When you sign in using OAuth providers (such as Google or YouTube), we receive information permitted by your authorization, such as your name, email address, and channel details. We may also receive referral attribution data from affiliate partners.

4. Legal Bases for Processing (GDPR Article 6)

If you are located in the European Economic Area (EEA), United Kingdom, or another jurisdiction that requires a legal basis for processing personal data, we rely on the following grounds:

  • Consent: For non-essential cookies, analytics (where required), marketing communications, and session recording. You may withdraw consent at any time.
  • Contract: To provide the Platform, process your subscriptions, deliver AI video services, and fulfill our agreement with you.
  • Legitimate interests: To maintain Platform security, prevent fraud, improve our products and services, and conduct internal analytics, where these interests are not overridden by your rights.
  • Legal obligation: To comply with tax, accounting, and regulatory requirements, and to respond to lawful requests from authorities.

5. Cookies and Tracking

We use cookies and similar tracking technologies to operate our Website, remember your preferences, analyze usage, and support marketing and affiliate programs. Cookies are grouped into categories: necessary, analytics, marketing, and session recording.

We use IP-based geolocation to determine the level of consent required before placing non-essential cookies. In France, no analytics scripts run until you provide explicit consent; rejecting cookies stops all measurement. In the rest of the EEA, UK, Switzerland, and Brazil, we use cookieless measurement that stores nothing on your device, and require opt-in consent for full analytics cookies; rejecting cookies means only anonymous, cookieless measurement continues. In other regions, non-essential cookies are enabled by default; opting out stops cookies and identifiers but anonymous, cookieless measurement continues. Where geolocation is unavailable, we default to requiring explicit consent before loading any analytics scripts. Enabling Global Privacy Control (GPC) in your browser disables all measurement, including anonymous signals, regardless of your region.

6. How We Use Your Information

We use your information for the following purposes:

  • Service delivery: To provide, operate, and maintain the Platform, including AI-powered video dubbing, transcription, thumbnail generation, shorts creation, and publishing features
  • Billing and account management: To process payments, manage subscriptions, and communicate about your account
  • Communications: To send service-related notices, respond to support requests, and (with your consent) send marketing communications
  • Analytics and product improvement: To understand how users interact with our Platform, diagnose issues, and develop new features
  • AI model improvement: We may use anonymized or aggregated data derived from your content to improve our AI models. You may opt out of having your content used for model improvement by contacting support@braiv.co.
  • Security and fraud prevention: To detect, investigate, and prevent unauthorized access, abuse, and fraudulent activity
  • Legal compliance: To comply with applicable laws, regulations, and legal processes

We do not sell your Personal Information to third parties.

7. Who We Share Data With

We share your information with trusted third-party service providers ("sub-processors") who assist us in operating the Platform. These providers are contractually obligated to protect your data and process it only for the purposes we specify.

Our key sub-processors include:

  • Google (Firebase, Analytics, Tag Manager, YouTube API, Cloud Storage) — authentication, hosting, analytics, video publishing, and file storage
  • PostHog — product analytics and feature flags
  • Stripe — payment processing and subscription management
  • Sentry — error monitoring and session replay
  • Intercom — customer support and messaging
  • Tolt — affiliate program tracking
  • Mux — video quality analytics
  • Vercel — application hosting

We may also share information with legal authorities when required by law, or in connection with a merger, acquisition, or sale of assets.

8. International Data Transfers

Braiv is based in Australia, but our service providers and infrastructure are located primarily in the United States. When we transfer your personal data internationally, we implement appropriate safeguards to protect it.

Where data is transferred to the United States, we rely on the EU-US Data Privacy Framework (DPF) for sub-processors that are DPF-certified. Where the DPF does not apply, we use Standard Contractual Clauses (SCCs) approved by the European Commission or equivalent safeguards.

PostHog processes data on US cloud infrastructure. By using our Platform, you acknowledge that your data may be transferred to and processed in the United States and other countries where our sub-processors operate.

9. Data Retention

We retain your information only for as long as necessary to fulfill the purposes described in this policy, unless a longer retention period is required by law. Our retention periods include:

  • Account data: Retained while your account is active, plus 30 days after account deletion to allow for recovery and final processing
  • Analytics data: 14 months (Google Analytics 4) and 12 months (PostHog)
  • Payment records: 7 years, as required for tax and accounting obligations
  • Session recordings: 90 days
  • Server logs: 30 days
  • Consent records: 3 years from the date consent was given or updated

When retention periods expire, we securely delete or anonymize your data.

10. Your Rights

Depending on your location, you may have the following rights regarding your Personal Information:

  • Access: Request a copy of the personal data we hold about you
  • Correction: Request correction of inaccurate or incomplete data
  • Erasure: Request deletion of your personal data
  • Portability: Request your data in a structured, machine-readable format

11. GDPR Rights (EU/EEA Residents)

We acknowledge that the General Data Protection Regulation (GDPR) may apply to our processing of personal data. Our Platform and Website are available in multiple languages and serve users globally, including in the European Union and European Economic Area.

If you are located in the EU/EEA, you have the rights described in Section 10 above. You also have the right to lodge a complaint with your local data protection supervisory authority.

12. CCPA/CPRA Rights (California/US Residents)

If you are a California resident, the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA) provide you with specific rights regarding your personal information:

  • Right to know: Request information about the categories and specific pieces of personal information we have collected, the sources, purposes, and third parties with whom we share it
  • Right to delete: Request deletion of your personal information, subject to certain exceptions
  • Right to opt out of sale/sharing: We do not sell your personal information. We do not share your personal information for cross-context behavioral advertising. You can use the "Do Not Sell or Share My Personal Information" link in our website footer to confirm your preferences.
  • Global Privacy Control (GPC): We honor GPC signals as a valid opt-out of sale/sharing of personal information.
  • Right to non-discrimination: We will not discriminate against you for exercising your privacy rights. We do not offer financial incentives for the collection or sale of personal information.

Categories of personal information collected: Identifiers (name, email, IP address), commercial information (subscription and payment history), internet activity (usage data, analytics), audio/visual information (uploaded content), and inferences (usage patterns).

13. Australian Privacy Act

We are committed to complying with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Under the Privacy Act, you have the right to access and correct your personal information, and to make a complaint if you believe we have mishandled your data.

If you are not satisfied with our response to a privacy complaint, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.

14. Children's Privacy

Our Platform is not intended for children under the age of 16. We do not knowingly collect Personal Information from children under 16. If you become aware that a child under 16 has provided us with Personal Information, please contact us at support@braiv.co and we will take steps to delete such information.

15. Automated Decision-Making

Our Platform uses artificial intelligence for video processing, transcription, dubbing, thumbnail generation, and related features. These AI systems process your content to deliver the services you request.

We do not make solely automated decisions that produce legal or similarly significant effects on individuals without meaningful human oversight. If you have concerns about automated processing of your data, contact us at support@braiv.co.

16. Google and YouTube API Services

Retention and Deletion of Google User Data

When you connect your Google account to our Platform, we may access certain Google user data (such as your name, email address, and YouTube channel details) as permitted by your authorization.
We retain Google user data only for as long as necessary to provide the services you have requested (such as enabling YouTube integration) and to comply with applicable legal, accounting, or reporting requirements.

You may revoke our access to your Google account at any time via your Google Account Permissions page at https://myaccount.google.com/permissions.
If you disconnect your Google account, or if you request deletion, we will promptly delete all Google user data associated with your account from our systems, unless we are required to retain it for legal reasons.
We do not share your Google user data with third parties except as described in this Privacy Policy, and we do not sell your Google user data.

Use of YouTube API Services

Our Platform uses YouTube API Services to provide video management, analytics, and publishing features.
By using these features, you agree to be bound by the YouTube Terms of Service and acknowledge that your use of YouTube is subject to the Google Privacy Policy.

If you connect your YouTube account to Braiv, we may access and process information such as your channel name, video metadata, and analytics, in accordance with the permissions you grant.
This information is used solely to provide YouTube-related functionality within our Platform, such as managing and publishing videos and retrieving performance data.
We do not share this information with third parties except as necessary to operate our services or as required by law.

You may revoke Braiv's access to your YouTube account at any time via your Google Security Settings page at https://security.google.com/settings/security/permissions.

17. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by email to the address associated with your account and by posting the updated policy on our Website. Your continued use of the Platform after such changes constitutes your acceptance of the revised Privacy Policy.
